1. Scope and service availability

These terms apply to the Asiye passenger and driver platform operated by ASIYE GROUP (PTY) LTD. The platform connects eligible independent drivers with passengers and delivery senders for available rides, Work/Club shared commutes and lawful parcel services. Availability depends on operating areas, approved driver supply, lawful operating requirements and the features offered in the app.

2. Accounts, profile capture and driver eligibility

Provide accurate account details and protect your login and pickup PIN. Live profile capture can be required to complete verification, as explained in the Privacy Policy. Drivers must complete the requested identity, licence, vehicle, address and banking checks and receive approval before dispatch access is enabled.

Driver approval does not replace a legally required operating licence, PrDP, roadworthiness, insurance, safety equipment or other transport requirements. Drivers must keep their documents current and update changes. Asiye retains its own review and oversight duties and may restrict access when eligibility or safety requirements are not met. See Driver Requirements & Ongoing Compliance.

3. Fare agreement, Cash and Card

The app shows the fare, fare offer/counter-offer or passenger share before acceptance. A driver and fare must be agreed before Card checkout. A passenger pays their agreed Card fare through Paystack before pickup is unlocked and before departure. For Work/Club, the pool must reach its applicable ready/accepted stage; each Card-paying passenger pays a separate agreed share to the same assigned driver's subaccount. Card availability is subject to payment-provider activation and approval.

Cash is collected by the driver after the ride or delivery. New bookings use Cash or Card. Do not send a new manual EFT as a Wallet top-up. The Wallet service is discontinued for new funding, bookings and ongoing cash-outs. Any historical funds are handled separately through the legacy-funds refund process and are not silently forfeited.

A successful Card checkout is a payment. Neither the app's internal payment status nor a booking countdown promises an escrow arrangement or delayed bank settlement until arrival.

4. Direct driver subaccounts and commission

Each eligible driver is onboarded as a Paystack subaccount with verified bank details. Each Paystack Card transaction includes the assigned driver's subaccount and applies an 80% driver / 20% Asiye split. Paystack settles the driver portion directly to that driver's bank account under its applicable settlement schedule. Asiye bears the Paystack transaction fee under this model, so Asiye's net receipt can be less than its 20% allocation.

Asiye does not use a model of collecting the full Card fare into its own account and later transferring the driver's share. Drivers must not substitute another person's subaccount for the assigned driver's approved account. Cash is collected by the driver; the platform commission is recorded and reconciled under the driver's agreement rather than a Paystack cash transaction.

5. Shared commutes and lawful parcels

Work/Club bookings can wait up to 30 minutes for compatible passengers. The countdown is a pooling period and does not itself create a waiting charge. Where seats do not fill, a revised fare requires explicit agreement; no revised amount is charged without the affected passenger's agreement.

Parcel senders must accurately describe lawful items, provide suitable pickup/recipient instructions and comply with any item restrictions. The assigned driver must complete the required arrival and pickup PIN checks before departure. A driver must not transport restricted, dangerous or unlawful items.

6. Pickup, sharing and conduct

The system issues the pickup PIN. Share it only with your assigned driver at pickup. The driver verifies it before starting the journey. Optional live-trip sharing with a trusted person is offered for safety and is not a prerequisite for booking or departure. Follow road and safety rules, treat others respectfully and contact emergency services directly in an emergency.

7. Cancellations, waiting fees and refunds

The Cancellation & Refund Policy, including its fee schedule, forms part of these terms. The current schedule is R0 for cancellation and R0 for waiting. No extra fare or future fee may be imposed retrospectively; any change must be disclosed before the affected booking is confirmed.

Use the app's cancellation control while it is available. If the driver has arrived, pickup is verified, a trip has started or a Card payment needs review, contact support. A cancellation request does not prove that a Card payment was voided or refunded. Asiye handles eligible refund and payment-dispute requests and will not require a customer to pursue the driver personally for a Card refund.

8. Complaints and privacy

Contact admin@asiye.cloud or 031 566 1165 with the trip/reference number for billing, lost items, service complaints or safety follow-up. Do not email passwords, full card details or pickup PINs. Personal information is handled under the Privacy Policy; privacy requests can be addressed to the Information Officer through the same official contacts.

9. Changes and applicable law

Material changes will be communicated through an appropriate channel and will not remove mandatory consumer rights. These terms are governed by applicable South African law and do not limit protections that cannot lawfully be excluded.
